These Terms of Service ("Terms") govern your access to and use of this website and your purchase of any products from us ("Velora", "we", "us"). By browsing this site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.
1. Who can order
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm you meet that requirement and that the information you give us is accurate and complete.
2. Products and descriptions
We describe our products as accurately as we can, including specifications supplied to us by our manufacturing partner. Product photography is illustrative; colours can vary slightly between screens and between production batches.
The Velora Wake Band is a consumer wearable intended for everyday wake-up and step tracking. It is not a medical or assistive device. It is not intended to diagnose, treat, cure or prevent any condition, and it should not be relied on as the sole means of waking for any safety-critical purpose. If you have a sleep, hearing or health concern, speak with a qualified clinician.
3. Pricing and availability
All prices are shown in US dollars and exclude taxes and any import duties unless stated otherwise. We may change prices, promotions and product availability at any time without notice.
We try to keep pricing accurate, but errors happen. If a product is listed at an incorrect price, we may cancel the order and refund you in full rather than fulfil at the incorrect price. We'll always tell you before doing so.
4. Orders
Your order is an offer to buy. We accept it when we send an order confirmation. We may refuse or cancel any order, including where we suspect fraud, where a product is unavailable, where a pricing error has occurred, or where an order appears to breach these Terms.
Please check your shipping address carefully. Once an order has shipped to an address you supplied, we can't recover it.
5. Payment
Payment is taken at checkout through our payment providers. By submitting payment details you confirm you're authorised to use the payment method. We don't store full card details.
6. Shipping and risk
Delivery estimates are estimates, not guarantees. Timings depend on our fulfilment partner and the carrier, and can be affected by customs processing on international orders. Full details are in our Shipping Policy, which forms part of these Terms.
Risk in the goods passes to you on delivery. Import duties and taxes on international orders are your responsibility.
7. Refunds
Our Refund Policy forms part of these Terms. In summary: you have 14 nights from delivery to request a full refund for any reason, and you keep the product. That policy is limited to one refunded order per customer, and we reserve the right to decline repeat requests from the same customer, address or payment method where there is evidence of abuse.
8. Warranty
We provide a 12-month limited warranty from the date of delivery against defects in the motor, battery or housing. It does not cover accidental damage, water damage from swimming or showering, or normal wear of the silicone strap. This warranty is in addition to, and does not affect, any rights you have under applicable consumer law.
9. Acceptable use
You agree not to use this site to break the law, to interfere with its operation or security, to scrape or harvest data, to submit false orders, or to misuse promotional codes. We may suspend access where we reasonably believe any of these are happening.
10. Intellectual property
All content on this site — text, images, graphics, layout and branding — belongs to us or our licensors and is protected by intellectual property law. You may not reproduce, republish or use it commercially without our written permission.
11. Third-party links and services
This site may link to or rely on third-party services, including payment processors and carriers. We aren't responsible for the content, policies or practices of third parties, and their terms apply to your use of their services.
12. Disclaimers
To the fullest extent permitted by law, the site and products are provided "as is" and "as available", without warranties of any kind beyond those expressly stated in these Terms or required by law. We don't warrant that the site will be uninterrupted or error-free.
13. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to your purchase is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential losses, including lost income, missed appointments, missed travel or missed commitments arising from reliance on the product as an alarm.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
14. Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the site.
15. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict of law rules. Disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan, unless mandatory consumer protection law in your country of residence gives you the right to bring proceedings elsewhere.
16. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.
